Legal Protection of the Egoza Trademark

The Egoza trademark is protected in accordance with international and national intellectual property laws. Trademark registration confirms the exclusive right of its owner to use the designation for product labeling, promotion, advertising, and other lawful actions within the designated classes of goods and services. Use of the trademark by third parties without an official license is considered unlawful and may lead to legal consequences.

International Registration via the Madrid System

The key element of the Egoza trademark's legal protection is its registration under the Madrid System of international trademark registration. Through the World Intellectual Property Organization (WIPO), the trademark is registered in two word formats:

  • “Егоза” (Cyrillic) – WIPO Registration No. ROM.1180273
  • “Egoza” (Latin) – WIPO Registration No. ROM.1227050

Thanks to this system, the trademark is recognized and valid in 99 countries, including most European nations, the United States, Canada, and other regions. Registration via WIPO allows for unified monitoring of the trademark’s status and confirmation of the owner’s exclusive rights in various jurisdictions.

National Registration in Ukraine and Kazakhstan

In addition to international registration, the Egoza trademark is protected at the national level:

  • In Ukraine, several active trademarks “Егоза” are registered, including Certificates No. 950706, No. 985213, No. 985211, No. 985220, and No. 981605. These registrations cover various classes of goods and services, allowing the trademark to be used for a wide range of products, including razor wire, perimeter barriers, plastic structures, warning signs, and components.
  • In Kazakhstan, the trademark is registered under No. 148810. This registration operates under the national intellectual property system and also covers specific classes under the Nice Classification applicable to typical Egoza products.

Each of these national registrations grants the owner exclusive usage rights and the ability to pursue legal protection against infringement.

Nice Classification Classes

Trademark registration always includes a list of classes under the Nice Classification of Goods and Services that define the legal scope of protection. For the Egoza trademark, the following classes are protected:

  • Metal products (including razor wire, barriers, and components);
  • Plastic and composite products (nets, bumpers, modular structures);
  • Individual and collective safety equipment;
  • Packaging and product labeling;
  • Informational and promotional materials.

This means that the Egoza designation may only be used in relation to products falling within these protected classes. Use of the trademark outside of these classes may be considered a violation of the owner’s rights.

Unlicensed Use of the Trademark

The use of the Egoza trademark without official authorization is considered unlicensed and violates the exclusive rights of the owner. Such violations include:

  • Applying the designation to products, packaging, or technical documentation;
  • Using the trademark for advertising or marketing purposes;
  • Registering domain names containing the Egoza designation;
  • Falsifying labeling or forging logos containing the name.

Even if the product characteristics resemble those of Egoza-branded items, selling it under the Egoza name without a license remains unlawful. This includes both commercial use and unauthorized references in public sources such as websites, catalogs, or documentation.

Legal Protection and Liability

The trademark owner has the right to protect their interests through administrative or judicial proceedings in any country where protection is valid. If unauthorized use is discovered, the following actions may be taken:

  • Filing lawsuits in commercial or civil courts;
  • Appealing to antitrust or customs authorities;
  • Blocking websites and online content;
  • Claiming compensation for damages.

Registration with WIPO and national registries in Ukraine and Kazakhstan gives the owner legal tools to defend their rights in all jurisdictions where the trademark is protected.
